BOOKING AND SERVICES TERMS & CONDITIONS:

Denia Sport Fishing

These Terms & Conditions govern the booking and provision of Denia Sport Fishing services. By making a booking, the client confirms that they have read and fully accepted these terms. For online bookings, acceptance is completed during the booking process. For bookings made by other means (phone, WhatsApp, email, etc.), booking the service implies acceptance of these terms, which are available on request and can be sent to the client upon request.

1) Booking request and confirmation

  • The booking form is a request, not an automatic confirmation.

  • A booking is confirmed only when the skipper/captain validates it (via email/WhatsApp/message).

  • We may refuse or cancel a request in cases of unsafe conditions, operational incompatibility, breach of rules, or inappropriate behaviour.

2) Weather, sea conditions and safety

  • All trips depend on weather and sea conditions.

  • For safety, the skipper/captain may change the route, timetable, effective duration, or activity plan, or end the trip if required by regulations or sea conditions.

  • The skipper/captain may cancel before departure if conditions are considered unsafe.

  • In spring and summer we recommend early departures (typically 06:00–08:00). In Denia, thermal winds often build and from around 13:00 the sea can become less comfortable.

3) Payments

  • To book, you select a date and pay the deposit shown in the online booking process.

  • The remaining balance is paid before boarding, in euros (€), unless otherwise agreed in writing.

  • Once the boat has departed, the activity cannot be cancelled with a refund, including in cases of seasickness, discomfort, or any incompatibility with the sea/activity, as the booking blocks a time slot and prevents us from accepting other trips.

4) Cancellations, refunds and no-shows

  • Cancellation by Denia Sport Fishing (safety/weather): if we cancel before departure due to sea/weather/safety, the client may choose to reschedule or request a refund of amounts paid (deposit and/or payments made), where possible via the same payment method.

  • Cancellation by the client: if the client cancels with less than 30 days’ notice, the deposit and any amounts paid are non-refundable.

  • No-show: if the client does not arrive at the agreed time and place, it is considered a no-show and no refund is due.

  • Meeting point and time are shown in the LOCATION tab and/or confirmation email. Arriving early is recommended.

5) Minors and group responsibility

  • Minors must be accompanied by a responsible adult.

  • The accompanying adult assumes direct supervision and responsibility for minors throughout the activity.

  • Specific conditions (e.g., minimum age of 8 for fishing) may apply and will be stated in the relevant service information.

6) Conduct on board, health and client obligations

  • The client agrees to board in a fit state for the activity, and not under the influence of alcohol/drugs.

  • Following the skipper/captain’s instructions and safety rules is mandatory.

  • The client must inform us before booking of relevant allergies and medical conditions that may affect the activity (seasickness, mobility limitations, etc.).

  • Sea navigation and marine activities involve risks. The client agrees to act prudently and responsibly.

7) Damage and use of equipment

  • Damage caused by negligent or improper use, or failure to follow instructions, may be charged to the client.

8) No guarantee of results

  • We do not guarantee catches, species or fish size, nor exact routes or wildlife sightings. We commit to providing the best possible service based on real conditions on the day, applying our experience and effort. In fishing, no-one can guarantee what will bite. Likewise, dolphin or marine wildlife sightings are occasional and depend on natural factors, so they cannot be guaranteed by any charter operator.

9) Data protection and communications

  • Personal data provided is used to manage the booking and service-related communications. Data will not be shared with third parties except where legally required or operationally necessary for booking/payment.

10) Applicable law

  • These Terms & Conditions are governed by Spanish law. Any dispute will be submitted to the competent courts/tribunals as determined by applicable regulations.

11) Precedence of the accepted version

  • In case of discrepancy, the terms accepted by the client at the time of booking during the contracting process shall prevail.

12) Recommendations – what to bring (not provided on board)

It is the client’s responsibility to come prepared for the day’s conditions. We recommend sun protection (sun cream, cap/hat, sunglasses), non-slip footwear, and extra water if desired. If you plan to swim: towel and swimwear. In colder or windy months: warm layers/windbreaker. For comfort: seasickness medication if you are prone to it (at your own responsibility). These items are not provided on board.

SPECIFIC TERMS - PRIVATE FISHING CHARTER

A1) Service and boat

Private fishing charter in Denia with skipper/guide departing from Club Náutico de Dénia on LUNAMARINA (Merry Fisher 6 m), within the legal operating area and subject to conditions on the day.

A2) Included

  • Skipper (fishing guide during the activity)

  • Required fishing licences (where applicable)

  • Passenger insurance

  • Boat and safety equipment

  • Fuel within the planned trip

  • Fishing equipment and basic tackle (rods/reels depending on method), lures/bait subject to availability

  • Water and soft drinks

A3) Not included

  • Transport to the boarding point

  • Meals

  • Costs arising from negligent/incorrect use causing damage to equipment or boat

  • Any service not listed under “Included”

A4) Capacity

Maximum 4 anglers + skipper. Recommended 3 for comfort and better guidance.

A5) Methods and species (indicative)

Techniques and target species depend on season, sea conditions, regulations and the day’s conditions.
Important: catches, species and sizes are not guaranteed.

SPECIFIC TERMS - PRIVATE BOAT TRIP / SKIPPERED BOAT HIRE

B1) Service and boat

Private boat trip in Denia with a skipper/local guide departing from Club Náutico de Dénia on LUNAMARINA (Merry Fisher 6 m), within the legal operating area and subject to conditions on the day.

B2) Included

  • Skipper (local guide during the activity)

  • Passenger insurance

  • Boat and safety equipment

  • Fuel within the planned trip

  • Water and soft drinks

B3) Not included

  • Transport to the boarding point

  • Meals and additional drinks

  • Towel, swimwear, hat, sunglasses and sun cream

  • Costs arising from negligent/incorrect use causing damage to equipment or boat

  • Any service not listed under “Included”

B4) Capacity

Maximum 4 passengers + skipper. Recommended 3 for comfort.

B5) Routes and sightings (indicative)

Routes can be adapted to client preferences where conditions allow, within the operating area.
Important: exact routes and sightings (dolphins/cetaceans, etc.) are not guaranteed; they depend on sea/weather and safety.

B6) Swimming / entering the water

If swimming/entering the water takes place, the client accepts that:

  • It is voluntary and at the client’s own responsibility.

  • The client declares they can swim and understand sea risks (waves, currents, slips, seasickness, etc.).

  • Minors may only swim under the direct and continuous supervision of the responsible accompanying adult, who assumes responsibility for minors during swimming.

  • The skipper/captain may prohibit or end swimming if it is considered unsafe.
